Six Individuals Indicted on Child Exploitation Charges

Memphis, TN -David Kustoff, United States Attorney for the Western District of Tennessee, announced today a federal grand jury returned five (5) indictments charging six (6) individuals with various violations of federal criminal law involving the use of a minor for the production of child pornography; distribution, receipt and possession of child pornography; and use of a computer to solicit a minor for sexual purposes. The indictments resulted from investigations conducted by member agencies of the Memphis Crimes Against Children Task Force - specifically, the FBI, ICE, Shelby County Sheriff’s Office, and Memphis Police Department. The individuals charged in the indictments are as follows:

OVELL EVERS, 53 year old, Memphis, Tennessee resident: Four (4) count indictment charging two (2) counts of production of child pornography by use of a 13 year old female minor engaging in sexually explicit conduct in violation of 18 U.S.C. §2251; one (1) count of possession of child pornography, and a forfeiture count. Maximum penalty for each violation of the Production statute, not less than 15 years not more than 30 years prison, $250,000 fine, or both; Maximum penalty for Possession, not more than 10 years prison, $250,000 fine, or both.

MARK WOODSON MANGRUM, 47 year old Parsons, Tennessee resident: One (1) count indictment charging use of a facility and means of interstate commerce (computer) for the purpose of attempting to persuade and entice a minor to engage in unlawful sexual activity, in violation of 18 U.S.C. §2422(b); Maximum penalty for violation of this statute, not less than 10 years not more than life in prison, $250,000 fine, or both;

JAMES MARSHALL VANDIVER, 28 year old Humboldt, Tennessee resident: One (1) count indictment charging use of a facility and means of interstate commerce (computer) for the purpose of attempting to persuade and entice a minor to engage in unlawful sexual activity, in violation of 18 U.S.C. §2422(b); Maximum penalty for violation of this statute, not less than 10 years not more than life in prison, $250,000 fine, or both;

DONALD EDWARD KLINE, 29 year old, Bartlett, Tennessee resident: Six (6) count indictment charging four (4) counts of Receipt of child pornography in violation of 18 U.S.C. §2252(a)(2); one (1) count of Possession of child pornography in violation of 18 U.S.C. §2252(a)(4)(B), and a forfeiture count; Maximum penalty for Receipt, not less than 5 years not more than 20 years prison, $250,000 fine, or both; Maximum penalty for Possession, not more than 10 years prison, $250,000 fine, or both.

AARON LUIS COLON, 24 year old, Millington, Tennessee resident: Five (5) count indictment charging three (3) counts of Receipt of child pornography in violation of 18 U.S.C. §2252(a)(2); one (1) count of Possession of child pornography in violation of 18 U.S.C. §2252(a)(4)(B), and a forfeiture count; Maximum penalty for Receipt, not less than 5 years not more than 20 years prison, $250,000 fine, or both; Maximum penalty for Possession, not more than 10 years prison, $250,000 fine, or both.

DANNY LEE DEWEY, 42 year old, Kent, Washington resident: Two (2) count indictment charging Distribution of child pornography in violation of 18 U.S.C. §2252(a)(1). Maximum penalty for Distribution, not less than 5 years not more than 20 years prison, $250,000 fine, or both.

These cases are being brought as part of Project Safe Childhood. In February 2006, Attorney General Alberto R. Gonzales created Project Safe Childhood, a nationwide initiative designed to protect children from online exploitation and abuse. Led by the United States Attorneys Offices, Project Safe Childhood marshals federal, state and local resources to better locate, apprehend, and prosecute individuals who exploit children via the Internet, as well as identify and rescue victims.
